General Terms and Conditions of Sale (CGV) – mandaa

Article 1 – Seller Identification and Scope
The website mandaa.shop is operated under the trade name “mandaa” by AMANDA MURPHY, a sole proprietor. Legal form and company name: Sole proprietorship. SIRET number: 941 827 362 00004. These General Terms and Conditions of Sale govern all purchases of products offered through mandaa.shop. They apply to consumers and, where relevant, business customers. Placing an order constitutes acceptance of these terms in the version available at the time of purchase.
Customers must be at least 18 years old, or have the authorization of a parent or legal guardian, and must have the legal capacity to enter into a contract.
Article 2 – Products and Availability
The essential characteristics, photographs, dimensions, materials and prices of products are presented on the relevant product pages. Product images are provided for illustration and reasonable variations in color or appearance may occur because of screen settings, manufacturing processes or the handcrafted nature of certain items.
Products are offered subject to availability. Adding a product to a shopping cart does not reserve it. If a product becomes unavailable after an order has been placed, mandaa will notify the customer promptly and offer either a suitable alternative, where accepted by the customer, or a full refund for the unavailable product.
Article 3 – Prices, Taxes and Customs Charges
Unless otherwise stated, prices are displayed and charged in United States dollars (USD). The price applicable to an order is the price displayed at checkout when the customer confirms the purchase. Shipping charges, applicable sales taxes and any other mandatory charges are shown before final payment.
mandaa may change its prices at any time, but a change will not affect an order that has already been accepted. In the event of an obvious pricing or technical error, mandaa may cancel the affected order before dispatch and issue a full refund.
For international deliveries, the recipient may be responsible for import duties, customs fees, local taxes and clearance charges imposed by the destination country, unless checkout expressly states that such charges are included. These charges are not controlled by mandaa.
Article 4 – Orders and Contract Formation
Before submitting an order, the customer can review the selected products, quantities, delivery details and total price and correct any errors. The customer confirms the order by selecting the final payment or purchase button and completing the required payment steps.
An automated order acknowledgment confirms that the order has been received but does not by itself constitute acceptance. The sales contract is formed when mandaa sends an order confirmation or dispatch confirmation, whichever occurs first.
The customer is responsible for providing complete and accurate contact, billing and delivery information. mandaa is not responsible for delays or additional costs caused by incorrect or incomplete information supplied by the customer.
mandaa may refuse or cancel an order in the event of suspected fraud, unauthorized payment, an obvious pricing error, product unavailability, an unlawful transaction, an undeliverable address or a breach of these terms. Any amount collected for a canceled order will be refunded to the original payment method.
Article 5 – Payment
Payment is due in full when the order is placed. Available payment methods are displayed at checkout and may include major credit or debit cards and supported digital wallets. Unless a product page and checkout expressly identify a recurring purchase, all payments are one-time payments and do not mandaa a subscription.
Payments are processed securely by Stripe or another payment service provider identified at checkout. mandaa does not directly store complete payment card numbers. Payment information is handled in accordance with the security and data-protection standards of the relevant payment provider.
The customer confirms that they are authorized to use the selected payment method. If payment is declined, reversed or not authorized, the order may be suspended or canceled. The payment descriptor appearing on the customer’s statement may include “MANDAA.”
Article 6 – Processing and Delivery
Orders are normally processed within one to three business days, excluding weekends and public holidays. Estimated delivery times and shipping costs are displayed at checkout. Typical delivery after dispatch is three to seven business days within the contiguous United States and seven to twenty business days for international destinations. These timeframes are estimates and are not guaranteed unless an express guaranteed service is offered at checkout.
Delivery is available only to destinations offered during checkout. The customer will receive tracking information when tracking is available. Delivery may be delayed by carriers, customs procedures, weather, public authorities, incorrect address information or other circumstances outside mandaa’s reasonable control.
Risk of loss or damage passes to a consumer when the consumer, or a person designated by the consumer other than the carrier, takes physical possession of the products. If a parcel is visibly damaged, incomplete or appears to have been opened, the customer should document the condition, notify the carrier where appropriate and contact mandaa promptly. Failure to report damage immediately does not remove any mandatory legal rights.
If a parcel is returned because the address supplied by the customer was incorrect, incomplete or unclaimed, mandaa may charge the reasonable cost of reshipping it. If delivery becomes impossible and the order is canceled, the customer will be refunded, less any non-refundable carrier charges caused by incorrect information supplied by the customer where permitted by law.
Article 7 – Right of Withdrawal and Returns
mandaa grants consumer customers a contractual right to withdraw from an eligible purchase within fourteen calendar days after the day on which the customer, or a person designated by the customer, receives the product. Where mandatory consumer law provides a longer period or additional rights, that law will apply.
To exercise the right of withdrawal, the customer must send a clear statement of the decision to withdraw before the deadline by email to [email protected] or by mail to mandaa, Attn: Returns, 1506 Plymouth Lane, Brenham, TX 77833, United States. The notice should include the customer’s name, order number, products being returned and date of receipt.
Products must be sent back within fourteen calendar days after the withdrawal notice. Unless the product is defective, incorrect or damaged on arrival, the customer is responsible for direct return-shipping costs. Customers are strongly encouraged to use a tracked shipping service. Returns must not be sent cash on delivery.
The customer may inspect a product as they would in a physical store but may be responsible for diminished value caused by handling beyond what is necessary to establish its nature, characteristics and operation. Products should be returned with their accessories and, where reasonably possible, their original packaging.
The right of withdrawal does not apply where legally excluded, including personalized or made-to-order products, products made to the customer’s specifications, perishable goods, sealed products that are unsuitable for return for health-protection or hygiene reasons once unsealed, and digital content supplied immediately with the customer’s prior consent and acknowledgment that the withdrawal right will be lost.
Eligible refunds include the product price and, when the entire order is withdrawn, the cost of the least expensive standard delivery option offered at the time of purchase. Additional costs for expedited delivery are not refundable. For a partial return, original delivery charges are not refunded unless required by law.
Refunds will be issued to the original payment method without undue delay and no later than fourteen calendar days after mandaa receives the withdrawal notice. mandaa may withhold the refund until the returned products are received or the customer provides evidence of shipment, whichever occurs first. No refund-processing fee will be charged.
Article 8 – Cancellations
A customer may request cancellation by contacting [email protected] as soon as possible. If the order has not entered processing or been dispatched, mandaa will make reasonable efforts to cancel it and issue a full refund. Once an order has been dispatched, the customer must follow the return and withdrawal procedure in Article 7.
Article 9 – Legal Guarantees and Defective Products
Products are covered by all non-excludable legal guarantees and statutory consumer rights applicable to the sale, including rights relating to conformity, satisfactory quality, merchantability, fitness for a particular purpose where applicable, and hidden or manufacturing defects. These rights are separate from and are not limited by the contractual withdrawal policy.
If a product is defective, damaged on arrival, materially different from its description or incorrect, the customer should contact [email protected] with the order number, a description of the issue and, where reasonably possible, photographs. mandaa may provide a prepaid return label and will offer an appropriate remedy, such as repair, replacement, price reduction or refund, depending on the circumstances and applicable law.
Legal guarantees do not cover normal wear and tear, accidental damage, misuse, improper storage, unauthorized modification, failure to follow care instructions or damage caused after delivery by the customer or a third party. Any additional commercial warranty will apply only if it is expressly described on the applicable product page or in a separate written warranty document.
Article 10 – Complaints and Customer Service

Telephone support is normally available Monday through Friday, 9:00 a.m. to 5:00 p.m. Central Time, excluding public holidays.
Customers should provide their name, order number, contact details and a clear description of the issue. mandaa aims to acknowledge written complaints within five business days and to provide a proposed resolution within fourteen business days, although complex matters may require additional time.
Customers are encouraged to contact mandaa before initiating a payment dispute so that the issue can be reviewed promptly. This request does not restrict any right to contact a card issuer, payment provider, consumer-protection authority or competent court.
Article 11 – Liability and Force Majeure
To the fullest extent permitted by law, mandaa is not liable for indirect, incidental or consequential losses that were not reasonably foreseeable when the contract was formed. Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, willful misconduct, personal injury caused by negligence or breach of mandatory consumer rights.
mandaa will not be responsible for a delay or failure caused by events outside its reasonable control, including natural disasters, severe weather, fire, war, civil unrest, labor disputes, epidemics, government action, customs delays, carrier interruptions, failures of telecommunications networks or payment-system outages. mandaa will notify affected customers where reasonably possible and take appropriate steps to reduce the impact.
Article 12 – Applicable Law and Disputes
These terms and all sales made through mandaa.shop are governed by the laws of the State of Texas and applicable federal laws of the United States, without regard to conflict-of-law principles.
If the customer is a consumer residing outside Texas, this choice of law does not deprive the customer of mandatory protections available under the law of the customer’s habitual place of residence. The customer may bring a claim before any court that has jurisdiction under applicable consumer law. Otherwise, disputes will be submitted to the competent state or federal courts serving Washington County, Texas.
Before commencing formal proceedings, the parties are encouraged to attempt in good faith to resolve the dispute by contacting [email protected]. Nothing in this article prevents either party from seeking urgent relief or using any mandatory consumer dispute-resolution process.
Article 13 – Severability and Changes
If any provision of these terms is held invalid or unenforceable, the remaining provisions will continue in effect. A failure by mandaa to enforce a provision does not constitute a waiver of that provision.
mandaa may update these terms for future transactions. The version accepted when an order is placed will continue to govern that order unless a change is required by law or is expressly accepted by both parties.
